Storage Eltham Terms and Conditions
These Terms and Conditions apply to all storage and related removal services provided by Storage Eltham within the United Kingdom. By booking or using any of our services, you agree to be bound by these Terms and Conditions. You should read them carefully before placing a booking.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below.
Customer means the person, firm or company who requests, books or pays for storage or removal services from Storage Eltham.
Services means storage, removal, transportation, loading, unloading, packing, handling and any associated services provided by Storage Eltham.
Goods means the items, belongings and property that are the subject of the Services.
Storage Facility means any premises used by Storage Eltham for the storage of Goods.
Contract means the agreement between Storage Eltham and the Customer for the provision of Services, incorporating these Terms and Conditions.
2. Scope of Services
Storage Eltham provides secure storage services and associated removal and transport services within the United Kingdom. The specific scope of the Services, including collection address, delivery address, storage term, and any additional services requested, will be confirmed in writing at the time of booking.
Any quotation or estimate issued is based on the information provided by the Customer and may be adjusted if that information is found to be inaccurate or incomplete.
3. Booking Process
All bookings for storage or removal services must be confirmed by Storage Eltham. An enquiry or quotation alone does not constitute a booking.
The Customer must provide accurate and complete information regarding the nature and quantity of Goods, access arrangements, addresses, dates and any special requirements. Failure to provide accurate information may lead to additional charges, delays, or refusal of service.
A booking is deemed accepted and a Contract formed only when Storage Eltham confirms the booking in writing or by issuing a booking confirmation or invoice. Storage Eltham reserves the right to refuse any booking at its discretion.
The Customer is responsible for ensuring that any person they authorise to act on their behalf in making a booking has the necessary authority to do so.
4. Quotations and Charges
Quotations are normally provided based on the information supplied by the Customer, including volume of Goods, access details, distance, and required storage duration. Quotations are valid for a limited time as specified at the time of issue or, if no period is stated, for 30 days.
Storage Eltham reserves the right to amend a quotation or apply additional charges if:
the information provided by the Customer was inaccurate or incomplete
additional services are requested after the quotation is issued
access to the property, premises or Storage Facility is different from that described
services are required outside normal working hours, or at short notice
there are delays or events outside the reasonable control of Storage Eltham that incur additional time or costs.
Unless stated otherwise, all charges are exclusive of any applicable taxes or statutory charges that may apply from time to time.
5. Payments and Billing
Unless otherwise agreed in writing, payment for removal services is due prior to or on the day of collection of Goods. Ongoing storage charges are generally payable in advance, either monthly or for such period as specified in the booking confirmation or invoice.
Payment must be made using a method accepted by Storage Eltham. The Customer is responsible for ensuring that payment details are valid and that sufficient funds are available.
If payment is not received by the due date, Storage Eltham may:
refuse to perform or continue to perform any Services
withhold delivery or release of Goods from storage
apply reasonable late payment charges or interest in accordance with applicable law
exercise a lien over the Goods until all outstanding sums, including charges and costs, are paid in full.
The Customer shall be liable for all costs reasonably incurred by Storage Eltham in recovering unpaid amounts, including legal and enforcement costs.
6. Customer Responsibilities
The Customer is responsible for:
ensuring that the Goods are properly packed, labelled and securely prepared for transport or storage, unless packing services are expressly included in the Contract
providing suitable and safe access to the premises at collection and delivery addresses, including arrangements for parking, permits and access times
ensuring that the Goods are lawful to possess, transport and store in the United Kingdom
notifying Storage Eltham in advance of any items that require special handling conditions, are fragile, or of exceptional value
keeping Storage Eltham informed of any change to contact details, billing address or authorised persons in relation to the Contract.
The Customer warrants that they are the owner of the Goods or are otherwise authorised by the owner to enter into the Contract and to arrange for the Goods to be stored or transported. The Customer agrees to indemnify Storage Eltham against any claim made against it by the owner or any other person with a legal interest in the Goods.
7. Items Not Accepted for Storage or Transport
For safety, legal and regulatory reasons, Storage Eltham will not accept certain items for storage or removal. These may include:
any illegal or unlawfully possessed items
explosives, firearms, weapons or ammunition
flammable, corrosive, toxic or hazardous substances, including gas cylinders, paints, solvents, chemicals and fuels
perishable, decomposable or infested items, including food and plants
cash, securities, precious stones, high value jewellery or collections unless expressly agreed in writing
animals, living organisms or any items requiring a controlled environment.
If prohibited items are discovered among the Goods, Storage Eltham may remove, dispose of or otherwise deal with such items at its discretion and the Customer shall be liable for any associated costs and liabilities.
8. Waste Regulations and Disposal
Storage Eltham operates in compliance with applicable UK waste management and environmental regulations. The Customer must not use storage facilities or removal services as a means of disposing of waste unlawfully.
The Customer is responsible for ensuring that any items presented for storage or removal are not designated waste under applicable legislation, unless prior written agreement has been obtained and lawful disposal arrangements made.
Where Storage Eltham agrees to remove unwanted items, such items may be treated as waste and will be disposed of lawfully. Additional charges may apply for such waste removal and disposal services. The Customer agrees to indemnify Storage Eltham for any costs, claims, penalties or liabilities arising from breach of waste or environmental regulations in connection with the Goods.
9. Access to Stored Goods
Access to Goods in storage is subject to the terms of the Contract and any site rules applicable at the Storage Facility. The Customer or any authorised person may be required to provide identification and proof of authority before access is granted.
Access may only be available during designated opening hours or by prior appointment. Storage Eltham may temporarily restrict access where necessary for safety, security, maintenance or other operational reasons. Reasonable efforts will be made to minimise disruption and to provide notice where practicable.
Where access by the Customer involves moving or handling Goods within the Storage Facility, the Customer must follow safety instructions and shall be responsible for any damage they cause.
10. Cancellations and Amendments
The Customer may cancel or amend a booking by providing notice to Storage Eltham. The timeframe and any cancellation or amendment charges will depend on the nature of the Services and the notice given.
Storage Eltham may charge a reasonable cancellation fee, including for loss of reserved time or resources, where cancellation occurs within a short period before the agreed service date. Where specific cancellation terms are provided in a quotation or booking confirmation, those terms will apply in preference to this general provision.
If the Customer wishes to change dates, addresses, volume of Goods or other key details after a booking has been confirmed, Storage Eltham will endeavour to accommodate such changes but cannot guarantee availability. Any change may result in revised charges.
Storage Eltham may cancel or suspend the Services if:
the Customer fails to make payment when due
the Customer breaches any material term of the Contract
provision of the Services would be unsafe, unlawful or impossible due to circumstances outside the reasonable control of Storage Eltham.
Where Storage Eltham cancels without fault on the part of the Customer, any pre-paid charges for unperformed services will normally be refunded.
11. Liability and Risk
Risk in the Goods remains with the Customer at all times, except during periods when the Goods are under the direct physical control of Storage Eltham for the purpose of carriage or handling. While in storage, the Customer remains responsible for insuring the Goods against loss or damage, unless the Contract expressly states that insurance cover is arranged through Storage Eltham.
Storage Eltham will exercise reasonable skill and care in providing the Services but shall not be liable for:
loss or damage arising from inherent defects, flaws or natural deterioration of the Goods
loss of or damage to items packed by the Customer where no external damage to the container is evident
indirect or consequential losses, loss of profit, loss of business, or loss of use
loss or damage arising from war, terrorism, civil unrest, natural disasters, extreme weather or other events beyond its reasonable control.
Any liability of Storage Eltham for loss of or damage to Goods, where established, may be limited to a specified amount per item or per consignment, as set out in the quotation or booking confirmation, or otherwise to a reasonable market value of the Goods at the time of loss, whichever is lower.
The Customer must inspect Goods promptly upon delivery or access and notify Storage Eltham in writing of any visible loss or damage as soon as reasonably practicable and, in any event, within a reasonable period permitted by applicable law or by any written terms provided at the time of booking. Failure to do so may affect the ability to investigate or resolve any claim.
12. Claims Procedure
If the Customer believes that Storage Eltham is responsible for loss of or damage to Goods, the Customer must provide written details of the claim, including a description of the Goods, evidence of ownership and value, and photographs where appropriate.
Storage Eltham may require the Customer to allow inspection of the Goods and any relevant documents. The Customer must cooperate fully with any investigation and with any insurance claim process where applicable.
Any settlement of a claim will be subject to the liability limitations set out in the Contract and these Terms and Conditions.
13. Termination of Storage
Either party may terminate an ongoing storage arrangement by giving notice in accordance with the Contract. The Customer must ensure that all outstanding charges are paid in full before removing Goods from storage.
If the Customer fails to collect the Goods or arrange continued storage following expiry of a storage term, or if charges remain unpaid for a prolonged period, Storage Eltham may, after giving reasonable notice where required by law, exercise a lien and dispose of some or all of the Goods in order to recover overdue amounts and reasonable costs. Any surplus funds from such disposal, after deducting sums due, will be held for the Customer where required by law.
14. Data Protection and Privacy
Storage Eltham may collect and process personal data relating to the Customer and their authorised representatives for the purposes of managing bookings, providing Services, taking payment, preventing fraud, and complying with legal obligations.
Personal data will be handled in accordance with applicable UK data protection law. The Customer is responsible for ensuring that any personal data they provide in relation to third parties is provided lawfully.
15. General Provisions
If any provision of these Terms and Conditions is held to be invalid or unenforceable by a court or other competent authority, the remaining provisions shall remain in full force and effect.
No waiver by Storage Eltham of any breach of the Contract shall be considered a waiver of any subsequent breach of the same or any other provision.
Except where expressly stated, nothing in these Terms and Conditions shall confer any rights on a third party under applicable third party rights legislation.
16. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter, formation or termination.
By proceeding with a booking or using the Services of Storage Eltham, the Customer confirms that they have read, understood and agreed to these Terms and Conditions.
